What is stopping Rare from doing a Banjo-Kazooie remake? Some sort of copyright problems or they just don't want to do it? All they would have to do is remake the game with updated graphics then maybe throw in a "remake mode" that has a couple new levels and Mumbo abilities and it would basically print money!

I know nothing about game development but I'd think it would be much easier to remake an older game then to create a brand new experience. There are so many older games they could remake that would make tons of money but they don't do it. Any big name game from the PS1/N64 era is a prime target for a remake since those early 3D visuals didn't age well.

They could do a remaster if they wanted to. They've already released it on XBLA & in Rare Replay, so they probably don't feel they need to do a big remake of it.
